The Leo Burnett Technology Group nearly found itself in the awkward position of having a client for which it was unable to create ads.

Evoke Communications, a Louisville, Colo., software company, had been in a legal dispute with Evoke Software over use of the trademark “Evoke.” During the dispute, both companies were prohibited from advertising.

But in announcing LBTG’s win of the $15 million account, Evoke Communications also announced it had settled the trademark dispute out of court and would be relaunching with a new name and brand identity.

Not surprisingly, LBTG’s first task will be to handle that relaunch, officials said.

“Our decision to settle the lawsuit and change our name was a move to control our own destiny and provide great certainty for our future,” said Paul Berbian, the former Evoke’s president and CEO in a release.
