MARC USA moved closer to picking up Pennsylvania’s three-year, $90 million lottery contract after a state hearing officer threw out the majority of protests filed by incumbent Tierney Com munications.

Tierney, however, said it will press on in its bid to retain the account, through both its remaining protest at the administrative level and with a state lawsuit.

In the meantime, the Philadelphia shop continues to create work for the lottery, despite the state’s selection of Pittsburgh’s MARC in a review that ended in February.

At that time, Tierney filed its protest and essentially charged that the process was rigged, saying the state’s proposal request was changed to make it difficult, if not impossible for the agency to retain the business.

Among Tierney’s accusations is that, as a public company, its financial statements required by the proposal take up vastly more space than those of privately held MARC.
