SYDNEY – United Biscuits-owned Australian snack food giant, The Smith’s Snackfood Company, could be forced to withdraw one of its newest potato crisp brands from the market after a Sydney Federal Court found it was a deliberate imitation of another brand. The court found the introduction, marketing and advertising of Smith’s Country Kettle Chips brand violated the Trade Practices Act. The Kettle Chip Company, a minor competitor in the market here, bought the action claiming Smith’s had attempted to pass its product off as Kettle’s own brand, launched two years earlier.
