Rather, CBS Comment on Today’s Proceedings

Dan Rather was back in court today in his lawsuit against CBS. Through his lawyer, Rather commented directly on the case.

“This suit is alive and well and moving forward. Reports of it’s demise seem to be wishful thinking on the part of some,” he said. “No amount of spin can undo the fact that this case is moving forward.”

Part of the action in court today revolved around Rather’s side amending the Complaint. “The facts alleged in the complaint remain, the punitive and compensatory damages remain, discovery continues and depositions are on the horizon,” said Rather.

Jim Quinn, lead counsel for CBS, tells TVNewser, “They have the right to amend whatever want. It’s kind of silly. They can amend and we’ll move to dismiss again, and I think we’ll be successful.”

Quinn also mentioned the part of the Complaint alleging Rather was taken off the air after he stepped down. “He continues with this fantasy that he was kept off the air. In fact once he stepped down, he was on I think two dozen times, on 60 Minutes and 60 Minutes II. We have the video tapes, it’s all on video.

“We’re looking forward to depositions,” Quinn said.
