Amazon Loses New York Suit

amazonloge.jpegA New York State Supreme Court Justice dismissed Amazon’s lawsuit against a new state law that allowed New York to collect sales tax from the bookseller.

New York Justice Eileen Bransten approved the state’s new law that collects sales on retail outfits that keep “affiliate networks” in the state and collect more than $10,000 in revenue there–despite the fact they aren’t headquartered in New York. The Channel Register has the story, speculating that the company will appeal.

The justice wrote: “In the end, the Commission-Agreement Provision does not broadly tax any and all Internet sales to New York consumers … The neutral statute simply obligates out-of-state sellers to shoulder their fair share of the tax collection burden when using New Yorkers to earn profit from other New Yorkers.” (Via Sarah Weinman)
