Sarah Palin Wins Appeal Reviving Defamation Lawsuit Against NYT

A federal court in Manhattan on Tuesday reinstated Sarah Palin’s defamation lawsuit against the New York Times, overturning a district court’s ruling which dismissed her claim in 2017. (Law & Crime)

The former Republican vice presidential candidate sued the paper in 2017 over an editorial linking one of her political action committee ads to a 2011 mass shooting that severely wounded then-Arizona Congresswoman Gabby Giffords. (THR / THR, Esq.)

In a unanimous ruling, the three-judge appeals panel said U.S. District Court Judge Jed Rakoff violated procedural rules when he dismissed Palin’s suit after an initial hearing that featured testimony from Times editorial page editor James Bennet. (Politico)

The appellate panel said Rakoff had relied on facts outside of legal filings in the case to dismiss Palin’s suit against the Times. (CNBC)
