The judge in Dan Rather’s case against CBS made another ruling late yesterday, though not much was decided.
Rather’s lawyers are now responsible for coming up with a new amended complaint by next Tuesday.
Rather’s lead attorney Martin R. Gold, issued this statement:
Justice Gammerman indicated his continued desire to move toward trial. He will be considering Mr. Rather’s second amended complaint, which adds more detail to the damages he suffered because of CBS’s acts of fraud. Justice Gammerman will also address the Thornburgh Panel’s attempt to block important documents from discovery.
Mindy Spector, a partner in the firm representing CBS, tells TVNewser, “Things went well yesterday as expected.” Spector expects the judge to reject the motion to amend.
One of the new issues raised by Rather’s lawyers was that he could have earned millions of dollars from future anchor jobs, specifically mentioning CNN. “There is nothing at this point other than sheer speculation from Dan Rather that any other network would have hired him or was interested in hiring him,” Spector said. However, Rather has worked for HDNet for two years.
As for the possibility of an upcoming trial, Spector tells us: “We are looking forward to being able to show we in fact complied with the contract.”
