Judge Andrew Napolitano: ‘I Think CNN’s Got a Very Good Case’

Fox News senior judicial analyst Judge Andrew Napolitano appeared on Stuart Varney‘s Fox Business program this morning, and said that Jim Acosta and CNN actually have “a very good case” in their lawsuit against the Trump White House.

“Obviously Acosta may have been an irritant to the president, but he was hardly a danger to him,” remarked Judge Napolitano. “So I think CNN’s got a very good case. I think this will be resolved quickly. I don’t expect a jury trial. I think it will either be settled or CNN will prevail on motion.”

The judge continued: “Believe it or not – Acosta would be entitled to a hearing and they would have to show which rule that he violated and the only rule that has anything to do with what he did is, was he a danger to the president or the president’s family? Obviously not.”

CNN and Acosta filed a lawsuit this morning, saying the administration “violated CNN and Jim Acosta‘s First Amendment rights of freedom of the press and Fifth Amendment rights to due process.” Among the defendants in the CNN lawsuit are President Donald J. Trump, John Kelly, Sarah Sanders, and White House deputy chief of staff for communications Bill Shine, who at one time was co-president of Fox News, before leaving in May 2017. Shine joined the Trump White House in July 2018.
