The Chicago Tribune is reporting Dave Savini, the investigative reporter for Chicago CBS owned station WBBM plans to fight the automatic suspension of his license after his DUI arrest last weekend.
Savini’s attorney is fighting Illinois’ Statutory Summary Suspension. According to a FAQ page on the Illinois Secretary of State’s website, the Statutory Summary Suspension “will result in a 6 or 12-month suspension” after a blood alcohol level more than a .08 in a chemical test.
The Tribune reports Savini’s lawyer filed a petition Wednesday in DuPage County:
The petition says Naperville police did not have probable cause to charge Savini with driving under the influence. The petition also says police did not follow proper procedures during Savini’s arrest and blood-alcohol test.
According to DuPage County court files, Savini’s blood-alcohol level registered .134 in the early-morning hours of Jan. 4, following his arrest by Naperville police on misdemeanor charges of DUI, battery, child endangerment and leaving the scene of an accident.
