What Constitutes 'Fair Use' for Bloggers?

Daily Finance’s Jeff Bercovici writes about Mediaite.com, specifically the site’s use of video content.

Mediaite, for anyone not familiar, uses video clips from various networks in most of its stories. Often the clips are part of an analysis of the news, sometimes they are not.

At the heart of Bercovici’s article is that while some networks are OK with Mediaite clipping their shows, others take issue with it:

[W]hen I asked an ESPN spokesmen about a five-minute clip of Pardon the Interruption that appeared on Mediaite’s sister site, SportsGrid, he replied, “The example you shared is a violation.”
