Can you be fired for making political statements your boss disagrees with? Yes. Can your old boss lie about you in a reference check? Apparently yes.

Joyce Lain Kennedy, syndicated career columnist, points out in a recent column that actually employees and jobseekers have fewer rights than you might think. Freedom of speech, for example, doesn’t apply in the private sector.

And can your boss lie about you in a reference check? According to author Lewis Maltby, “courts give employers a great deal of leeway in defamation cases. If it’s a close call, the employer typically gets the benefit of the doubt.” Plus, you’ll probably never hear the details from your potential new employer—they don’t want to reveal the reason you weren’t hired.
