“We have concluded that the established facts do not constitute a crime under New York criminal law,” a spokeswoman for the Manhattan District Attorney said.
The investigation, which was opened last month, was handled by the Manhattan District Attorney’s office because Kelly is the son of New York police commissioner Ray Kelly.
The WNYW anchor, who took a leave of absence from the Fox O&O during the investigation, issued a statement Tuesday night.
“I am so thankful the investigation established what I’ve known all along, that I am innocent of the allegations that were waged against me,” Kelly said. “I am so blessed to have a wonderful family and friends whose support for me never wavered.”
Kelly added extra gratitude to the thousands of WNYW viewers “who expressed positive support through social media.”
“I am grateful to everyone at Fox 5, especially Rosanna Scotto, my co-host. I will always remember her kindness, and I look forward to soon resuming my post on Good Day New York next to her,” Kelly said.
