Patrick Fay, who is known as Patrick Hammer on-air at WGRZ in Buffalo, N.Y., where he works as a meteorologist, has been charged with felony aggravated DWI.

The Buffalo News reports, he was arrested after allegedly driving into a ditch. “I asked him how he ended up in the ditch, and he could not come up with an answer,” officers said in a report.

The officer said Fay told him he had “a couple of drinks,” but could not recite the full alphabet at the officer’s request. He said Fay also had difficulty with several balance tests when he got out of his vehicle. When officers administered a breath test, Fay’s blood-alcohol level was higher than .18 percent, which is more than double the state’s legal limit.

Fay has a previous conviction for driving under the influence of alcohol in 2014 in Minnesota. He started at WGRZ more than five months ago.

Aggravated DUI means the driver has a blood alcohol content of 0.18 or more.
