WASHINGTON, D.C. – Even though the Supreme Court has lifted a ban on broadcast gaming ads, shops are not eager to change their practices until the government decides what is allowed in states where casinos are illegal.
Legal scholars say agencies can air gaming ads in the 10 states where private, non-Indian casinos are legal (Colorado, Illinois, Indiana, Iowa, Louisiana, Mississippi, Missouri, New Jersey, Nevada and South Dakota). Elsewhere, the Federal Communications Commission must decide whether the court’s decision applies.
“Personally, I do not want to be a test case, but that doesn’t mean there won’t be some groups who may try,” said Michael Mayes, president of Dunn Reber Glenn Marz in Las Vegas, which handles the Mandalay Bay Resort and Casino.
