Lawsuit Against David Cross, Warner Music Dismissed

A lawsuit filed in federal court by a Nashville nightclub owner against comedian David Cross, his record label, SubPop, and its parent company Warner Music and its distributors has been dismissed. According to court documents, the plaintiff, Thomas Weber, manager of the Exit/In, had accused Cross of showcasing Weber on Cross’ Shut Up You Fucking Baby CD and subsequent Let America Laugh DVD without his consent.

Weber’s case against Cross was dismissed in April; his case against Warner Music, SubPop Records, WEA Corporation, and the Alternative Distribution Alliance — the labels and distributors of the CD and DVD — was dismissed in late July, but, as The Apiary notes, only after Weber refused the defendants’ settlement offer of $30,000 and instead sought $120,000.
