Alexis Berger, the former svp of sales for the Midwest and West Coast offices of mobile advertising company Kargo, was awarded $40 million in a third-party arbitration ruling that Adweek obtained last week. While a federal court will still need to issue a decision on the case, how the arbiter, Judge Billie Colombaro, came up with the $40 million sum is now posted below.
The case alleged that Berger had experienced gender discrimination, retaliation, equal pay violation, violation of wage law and breach of contract.
In the award, Colombaro explained that Berger would be awarded:
- $305,131.33 for her commissions from Jan. 1, 2016 through May 2, 2016
- $305,133.15 for liquidated damages pursuant to NYLL 198 (1-A)
- $8,862,000 for her lost vested and unvested options
- $27,501,399 for equal pay liquidated damages
- $20,000 for NYLL 215 for liquidated damages for retaliation
- $60,000 for emotional distress damages
- $300,000 for punitive damages
- Retaining her $100,000 bonus
